"About 99.99% of deaths in police custody can be ascribed to torture and occur within 48 hours of the victims being taken into custody.
Though Maharashtra has a total population of 112 million in comparison to 199 million in Uttar Pradesh and in comparison to Bihar 103 million - according to 2011 census.
The fact that 76 more persons were killed in comparison to UP and 147 more persons in comparison to BIHAR - in police custody in Maharashtra shows that torture is more rampant in police custody in Maharashtra than Uttar Pradesh and Bihar ."- further asserted Mr Chakma .
POLICE CUSTODIAL DEATHS-POSITION OF BIHAR
VIS-A-VIS OTHER STATES :
National Human Rights Commission (NHRC) compiles annual statistics of police
custodial deaths in the country and so also National Crime Records Bureau
(NCRB). The latest report of NHRC is available only up to the year 2009-10.
Report after 2010 has not been released by NHRC as yet. Based on the report of
NHRC (till 2009-10) and NCRB data for the year 2011 and 2012, National figure
of Police Custodial Deaths has been prepared. It shows positive improvements
in respect of Bihar when compared with the national scenario. Data for 2005
to 2012 shows that Bihar now stands at FOURTEENTH (14th) position vis-à-
vis other states.
The states which have recorded higher number of custodial deaths than Bihar
between 2005 to 2012 are as under —
Maharashtra-169, Uttar Pradesh-122, Gujarat-91, Andhra Pradesh-
74, Tamil Nadu-55, Assam-51, Madhya Pradesh-49, West Bengal-37,
Punjab-29, Haryana-28, Karnataka-24, Rajasthan-23, Kerala-22 &
BIHAR- 22
While it used to be on an average eight custodial deaths per year between 1995
to 2005 (Appendix-B), it has come down to an average of THREE per year
between 2005 to 2012 (Appendix-A). Bihar which used to be at NINTH
position in the country during 1995 to 2005, has now improved
to FOURTEENTH position vis-à-vis other states during the year 2005 to 2012
The states which had recorded higher number of custodial deaths than Bihar
between 1994 to 2005 were —

Murders are heinous crimes , corruption is worst crime, brutalities are worst crimes -POLICE IS MADE TO PROTECT THE people of the country FROM injustice , crimes and terror - public pays them well and gives them all powers लेकिन उल्टा राज है। but police itself is involved in all crimes - all on the name of law & order -ALL THESE ACTS ARE UNLAWFUL , THIS MEANS POLICE IS WORST OF WORST CRIMINALS (simply because police is paid for enforcing law of the land and do justice to the people ) - but POLICE IS ALL CRIMES -POLICE STATIONS ARE CRIME STATIONS .HOW CAN CRIME CENTERS GIVE JUSTICE .
ये अव्यवस्था है ।
Police is an employment , police CAN never do these criminal acts of their own simply because they will loose their job , NO ONE will ever risk their job - very livelihood .
THESE ARE CRIMINAL POLITICIANS WHO HAVE FORCED THEM IN TO CRIME .

POLICE THINK THEY ARE SUPREME IN THE COUNTRY - no one can bring them to justice. One police inspector BB.Nanaware has committed several failed murder attempts on my life .
CONVICTION RATE of COPS in Maharastra :
1) When Maharastra cops are accused - Only one cop in 1,382 get Convicted in Maharashtra - report in Times of India 4/4/2016 .
1)RTI activist , Jitendra Ghadge says : I have personal experience of filing complaints against cops . Senior IPS officers protect their juniors , whereas the complainant is targeted by the same cop.
2) The statistics are clear enough about action taken . These allegations need to be probed and only then further action is possible . Pravin Dixit Director General of Police .
Criminal lawyer Majeed Mamon said - the Supreme court has shown anguish on the way probes against rough cops are carried out by their own department ." The SC is conscious of the fact that police officials go soft on their own caught for any offence . The chargesheet filed in the case is ( dilute ) . Also , it is difficult to get the testimony ( victims ) during the trials as they fear backlash from the same cop , if he or she gets back in to the force.
Police officers are well qualified ,mostly coming from well to do educated families - what explanation these police officers have ABOUT THEIR JUSTICE SYSTEM.
IF POLICE ARE TREATED -The way police treats INNOCENT people of the country - WHAT WILL HAPPEN ?.
What can be said of "THIS JUSTICE SYSTEM" of MAHARASTRA POLICE -
CAN IT BE CALLED :-
- MOCKERY OF JUSTICE,
-RIDICULING JUSTICE,
-CONTEMPT OF JUSTICE ,
-JOKING THE JUSTICE ,
-TEASING AND TAUNTING THE JUSTICE .
HOW CAN THIS JUSTICE SYSTEM BE DEFINED - CAN IT BE CALLED " MAHARASTRA JUSTICE SYSTEM ".
If complaints are false then why those complainants are not prosecuted .
Can any one dare to make a false complaint against police ?.
POLICE BRUTALITY :
The supreme court has condemn cruelty or torture as being violative of art 21 in following words " any form of torture and cruelty or degrading treatment would be offensive of human dignity and it would on its view , be prohibited by article 21. It would be seen that there is implicit in article 21 the right to protect against torture or cruel ,inhuman which is enunciated in article 5 of Universal Declaration of Human right and guaranteed by Article 7 of International Covenant on Civil and political rights .

All the above factors combined to produce a system, which situated the bulk of the police force at a distance from the community.
Understandably, the 1861 Act failed to produce an efficient, professional and an accountable police force in the country.
This was realised by the colonial rulers themselves. They ordered - the Indian Police Commission- and appointed in July, 1902 under the chairmanship of Sir A.H.L. Fraser - who concluded:
"The police force is far from efficient; it is defective in training and organisation; it is inadequately supervised; it is generally regarded as corrupt and oppressive; and it has utterly failed to secure the confidence and cordial co- operation of the people."
INTERNAL ENQUIRY MUST BE WITHDRAWN :
No suspect , accused or criminal can be Judge himself .Indian police is immune to all crimes -they have departmental enquiry which proves them innocent .
All complaints against police excesses , atrocities and crimes
- Police custody murders Police Brutality, Police Corruption, Police Harassment, police intimidation ,Police Abuse, Police Misconduct -must be dealt in with directly by SUPREME COURT .
Supreme court instead of giving them advisory - like install cctv camera etc. - deal directly with the crimes committed by police - the way common man is dealt in with BY POLICE -police will come to senses -instantly .
Provision of departmental enquiry must be limited to internal indiscipline as in any organization.

Custodial deaths are perhaps one of the worst crimes in a civilized society governed by the rule of the law . There are numerous cases where the police officers have misused their powers on the people and toyed with their lives .
The police officers , who are regarded as the custodian and guardian of law , have acted in just the contrary manner and have miserably failed to protect the very basic right to life guaranteed by article 21 of the constitution of India .
Custodial violence is a matter of most serious concern . Custodial violence is aggravated by the fact that it is committed by persons who are supposed to be the protectors of the citizens . It is committed under the shield of uniform and within four walls of a police station or lock-up , the victim being totally helpless.
POLICE CUSTODY MURDERS : "REMAND"

The Supreme court has viewed seriously ineffective implementation of series of directions to curb custodial deaths and sought explanation from the Centre and States after being informed that nearly 12,000 persons died either in jail or in police stations - in last five years .
A bench of justices S S Nijjar and F M Kalifulla was pained when amicus curie A M Sanghavi moved an application seeking implementation of 15 more guidelines to clamp down on custodial excesses , which resulted in the death of 11,820 deaths and 3,532 (very little fraction only ) reported cases of custodial torture between 2007 and 2012 - TORTURE CASES ARE JUST (tip of ice-burg )FRACTION .
Maharastra reported maximum number of custodial deaths in the country . It is note worthy that many of the custodial deaths admitted to by Maharastra are women.
ACTION AGAINST PERPETRATORS OF CUSTODIAL DEATHS IN MAHARASTRA :
Total number of cases admitted by the state was 72 ( in three years ), criminal action against perpetrators of custodial deaths had been initiated only in four cases .
The state did not inform about the out come of such criminal action initiated against the accused policemen.
Presumably politicians and police officers are protecting these perpetrators of heinous crime for obvious reasons .
THERE IS URGENT NEED TO RATIONALIZE POWERS OF POLICE AND POLITICIANS -TO MAKE POLICE AND POLITICIANS RESPONSIBLE AND ACCOUNTABLE TO THE PEOPLE OF THE COUNTRY.
POLICE CUSTODY - REMAND :
POLICE ARE GROSSLY MISUSING THIS POWER - TO THE GROSS DETRIMENT OF COMMON MAN - INNOCENT COMMON MAN IS FALSELY IMPLICATED AND TORTURED TO THE SUBMISSION AND MURDER ( MOST UGLIEST DEATH - WORST THAN WHAT WE SEE IN ANIMAL WORLD OF DISCOVERY CHANNEL- ( wild dogs segregating an animal -attacking and killing most mercilessly ) .
Manoj Yadav, 28, was crying when his father Dayanand Yadav met him in the lock-up of Sadar police station in Bihar's Nawada district on January 14. The police torture had left the tube-well mechanic in excruciating pain. He could not even eat the home-cooked food his father had brought.
The next day, Manoj's body was found in a barren field, sprawled in the dust, saliva oozing from his gaping mouth. This was the second time the police had arrested Manoj, who had no criminal record.
In November 2011, he was arrested for using a murdered businessman's mobile phone, which he had found abandoned in the streets.
The police released him after interrogation when he was found innocent. But with pressure mounting to crack the murder case, the police picked up Manoj again on January 11. This time, the police thrashed him in an effort to make him talk, killing him in the end.
His widow Reena Devi, a 25-year-old mother of three children, says, "My husband was naive to have used a lost mobile phone and paid with his life for the mistake. How do we survive now?" The incident sparked off a furore, forcing the police to file an FIR against five policemen. Superintendent of Police, Nawada, Surendra Lal Das claims Manoj was never arrested, but he fails to explain why, in that case, was the FIR lodged against the policemen.
POLICE CUSTODY MUST BE rarest of rare : भारत की पुलिस अपराधी न्याय व्यवस्था है।
जब किसी के साथ अन्याय होता है तो पुलिस के पास जातें है , पुलिस से न्याय की उम्मीद होती है। पुलिस खुद भयंकर अपराधों में डूबी है -वो क्या न्याय करेगी , ये जनता जानती है - फिर भी सरकार ने एक व्यवस्था बनायीं है -यही एक सहारा है - डुबाये या बचाए - यां और बर्बाद करे -यही एक सहारा है।
लेकिन सबसे जघन्य अपराध तो पुलिस करती है।तब कहाँ जाया जाय। किसके पास जाये। न्याय व्यवस्था के नाम पर पुलिस , गाजर मूली की तरह , किसी को भी पुलिस कस्टडी में ले लेती है। उस चार दीवार के भीतर बंद कमरे में बेसहारा , लाचार पर -कल्पना से परे जुल्म ढाते है। किस्मत अच्छी हुई तो जिन्दा बच जाता है -वर्ना मौत निश्चित है। आजादी के बाद से सारे अपराध पुलिस और नेता करते है -जुल्म जनता पर होते है।
जनता को न तो ऐसे अपराधी नेता चाहिए और न ही ऐसी अपराधी पुलिस। बंद करो ये पुलिस और नेताओं का -घिनोना सरकारी अपराधी न्याय व्यवस्था का नाटक। सब कुछ सुप्रीम कोर्ट संभालेगी।
पुलिस , पुलिस कस्टडी में रख कर , उसके साथ भयंकर क्रूर अत्याचार करके , उसको मार डालती है। आखिर पुलिस ये सबकुछ किस अधिकार या किस कारण से करती है। इससे क्या हासिल होता है। आखिर पुलिस बताना क्या चाहती है। कौनसी व्यवस्था की स्थापना कर रही है , भारत में .? . हजारों हत्याएं पुलिस कर चुकी है। इतने साल हो गए है , जिनकी हत्याएं होती है वे अक्सर गरीब होते है। अगर ये अच्छा काम है तो हत्या करने वाले पुलिस को , पुलिस अधिकारी को भारत रत्न का पुरस्कार मिलना चाहिए। राज्य सरकारों को , नेताओं को , भारत रत्न के पुरस्कार मिलने चाहिए - ऐसा अच्छा काम करने के लिए।
जिस तरह से फांसी की सजा rarest of rare होती है - पुलिस कस्टडी भी rarest of rare case में होनी चाहिए।
सभी चैनल इस पर बहस करें की हजारों मौतें जो पुलिस कस्टडी में हुई है उससे हासिल क्या हुआ है। इतना भयंकर अत्याचार (torture ) पुलिस कस्टडी में होता है उसका कारण होना चाहिए , मकसद होना चाहिए। हर पुलिस कस्टडी मौत की रिपोर्ट टीवी चैनल्स को देनी चाहिए , उसको जनता को जानने का अधिकार है। इसमें भी पारदर्शिता होनी जरुरी है । आपसी राजनीनिक रंजिश भी मौत का कारण हो सकती है।
CONCLUSION :
Crimes are committed by police But fact remains -POLICE IS AN EMPLOYMENT , THEIR SERVICES CAN BE TERMINATED, EVEN MOST STUPID WILL NOT RISK EMPLOYMENT .IT IS POLITICIAN WHO ARE RESPONSIBLE 100% FOR ALL THE CRIMES WITHIN POLICE -SIMPLY BECAUSE NOT A SINGLE POLITICIAN OR POLITICAL PARTY HAVE RAISED THIS ISSUE - THEY RAISED DADRI ISSUE, HYDERABAD ISSUE , JNU ISSUE .
CONCLUSION :
Each police custody murder be compensated with Rs.25 Lakh , to the next kith or kin with effect from past ten years or more .
